Acceptable Use Policy

ACCEPTABLE USE POLICY
Use of LTOL services constitutes acceptance of this agreement.

LTOL strives to provide the best possible internet and web-hosting services possible.  LTOL has an Acceptable Use Policy (AUP) for the protection of all of our customers.  In this, customer acceptance of the AUP is paramount in being able to give the best possible service. LTOL reserves the right to terminate any service at any time, without notice or refund.  Services may be terminated for violations of the AUP.

LTOL customers are responsible for the activities of their end users and by accepting services from LTOL agree to ensure that their end users will abide by this policy.

LTOL services are not to be used to send Unsolicited Commercial Email.  LTOL services may not be used to sending unsolicited bulk email (spam).  LTOL mailboxes may not be used as drop boxes.

LTOL services may not be used to display or transmit material that is unlawful, threatening, or libelous, or any other material deemed inappropriate or to engage in harassment through abusive language, frequency of messages, or size of message.

LTOL services may not be used to advertise, transmit, or otherwise make available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.

LTOL customers may not attempt to gain access to any account or computer resource not belonging to that customer.  Nor may they access, alter, destruct, or any attempt there of, any information that does not belong to them by any means or device.  LTOL customers may not attempt to circumvent user authentication on LTOL.

LTOL reserves the right to disconnect idle connections.  LTOL customers have access to the internet for active use.  The service does not permit in-active use, which is defined by automated checking of email, newsgroups, use of ping bots, etc.  If a customer is not actively using their connection, or stays connected for exceptionally long periods of time, the customer might be disconnected.

LTOL has a one account one session policy.  Simultaneous logins are not permitted.

LTOL offers no guarantee for the security of an LTOL customer password.  LTOL will make every effort to keep passwords secure, the customer has no enforceable right to total privacy from a data packet standpoint.  From a customer standpoint, an LTOL customer does have the fundamental right:  LTOL will not disclose any confidential information that is given to LTOL except where required by law.  LTOL will not sell customer information or email addresses.

LTOL expects and demands that any customer or end user while using the services of LTOL will not violate any laws while using the services of LTOL.

LTOL reserves the right to track and log all IP addresses, so that abuse complaints may be traced to their source.  Complaints can be emailed to support@ltol.com so the problem can be resolved.

LTOL does not permit the use of Personal Web Space/Pages for the following:

  1. Commercial purposes

  2. Offering for sale any products or services

  3. Soliciting for advertisers or sponsors

  4. Displaying a sponsorship banner of any kind

  5. Developing restricted or password only access pages or hidden pages or images.

  6. Promoting/Soliciting for participation of multi-level marketing/pyramid schemes

  7. Displaying banners for cash, cash equivalent, in exchange for hyperlinks to websites.

LTOL deems that website owner/customer is solely responsible for the content of their website.  LTOL is NOT responsible for any content.  Website owner/customer can be legally liable for any and all content of their website.  The owner/customer agrees to indemnify and hold harmless LTOL for any loss, liability, claim, damage or expense arising from or in conjunction with the contents of owner/customer’s web site.

LTOL offers no guarantees or warranty of any kind; use of LTOL services are ‘as is’.  LTOL is liable to any customer for any harm that may occur through their use of LTOL services, regardless of whom may be at fault.  In the case of a service outage, LTOL is not liable for any loss of data, income, goodwill, or any other damages beyond refund of fees.

LTOL reserves the right to delete any and all personal data after a customer no longer has service with LTOL.  LTOL reserves the right to remove any and all email account not used/accessed within a three month time period.

LTOL reserves the right to email LTOL customers at any time.

LTOL bills for internet services in advanced at the beginning of each month.  Cancellation requests MUST be received in writing and will not be honored retroactively nor will cancelled service be prorated.  LTOL reserves the right to suspend service for non-payment.  LTOL reserves the right to charge a $25.00 returned check charge for any and all returned checks.  LTOL reserves the right to charge a $25.00 charge on any and all declined/exception credit cards.  LTOL will bill $10.00 for any account that is 10 days past due, and will continue to charge $10.00 if the bill remains unpaid into succeeding months.  LTOL will charge the customer for all collection and reasonable attorney fees that accrue while collecting fees for services due that are past due.

LTOL is never responsible for any long distance charges that the customer or end user may incur.  It is the customer/end user responsibility to select/check for a local dial up number.

LTOL reserves the right to make changes to this and any policies at any time.
